Terms and Conditions

1. Acceptance of Terms

By accessing and using Email Pro SaaS ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these terms, do not use the Service.

2. Description of Service

Email Pro SaaS provides a web-based email marketing platform that allows users to:

• Compose and send email campaigns
• Manage subscriber lists
• Schedule email campaigns
• Track email delivery and performance
• Connect their own SMTP servers for email delivery
• Access email analytics including open rates, click rates, and engagement metrics (based on plan)

2b. Email Analytics

Growth and Pro plan users have access to email analytics features that may collect:

• IP addresses of recipients who open emails or click links
• Browser and device information (user agent)
• Geographic location derived from IP addresses (Pro plan)

You are responsible for informing your email recipients about tracking practices and ensuring compliance with applicable laws (CAN-SPAM, GDPR, etc.) in your jurisdiction.

3. Account Requirements

• You must be at least 18 years old
• You must provide a valid business email address (no free email services)
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete registration information
• You are solely responsible for all activities under your account

4. Acceptable Use Policy

You agree NOT to use the Service to:

• Send spam, phishing, or malicious content
• Send unsolicited bulk emails
• Harass, threaten, or defame others
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to other accounts or systems
• Distribute malware, viruses, or other harmful code
• Engage in activities that damage, disable, or impair the Service

5. SMTP and Email Delivery

• You provide your own SMTP credentials for email delivery
• You are solely responsible for the reputation and deliverability of your SMTP server
• We reserve the right to suspend accounts sending spam or harmful content
• You must comply with CAN-SPAM, GDPR, and other applicable email regulations

5b. Rate Limiting and Queue Priority

To ensure fair usage and optimal delivery, we implement intelligent rate limiting across all plans:

• Sending Limits: Each plan has monthly sending limits as specified in your selected subscription
• Queue Priority: Higher-tier plans (Growth, Pro) receive priority queue processing over lower-tier plans
• Delivery Optimization: We pace email sending to mimic natural patterns and improve deliverability
• Inbox Placement: While we optimize for delivery, inbox placement is ultimately determined by the recipient's email provider (Gmail, Outlook, etc.) and we cannot guarantee placement in Primary/Inbox folders
• Throttling: We may temporarily throttle sending if abnormal traffic patterns are detected to protect the platform

6. Subscription and Billing

• Subscription plans are billed monthly or yearly as selected
• All fees are non-refundable unless required by law
• Plan upgrades take effect immediately
• You may cancel your subscription at any time
• Access to paid features ends when the billing period expires after cancellation

7. Limitation of Liability

The Service is provided "as is" without warranties of any kind.

We do not guarantee:

• Email delivery (depends on your SMTP provider)
• 100% uptime or availability
• That the Service will meet your specific requirements

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold Email Pro SaaS harmless from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your emails violating applicable laws

9. Intellectual Property

• The Service, including all content and software, is owned by Email Pro SaaS
• You retain ownership of your content (emails, subscriber data)
• You grant us a license to use your content for providing the Service

10. Termination

We may terminate or suspend your account immediately if you:

• Violate these Terms and Conditions
• Send spam or abusive emails
• Fail to pay subscription fees
• Engage in illegal or harmful activities

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or dashboard notice. Continued use of the Service constitutes acceptance of updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes shall be resolved in appropriate jurisdiction.
